Apartment ownership or plot ownership

One conveys a home plus an undivided share you can never fence. The other conveys land you can. Almost every other difference follows from that single one.

What this page is

This page is about the form of ownership, not about the two products. If you want the product comparison — what is built, what you build, which regulator, which state — that is the apartment against villa plot page. Here the question is narrower and more useful: what does each deed actually convey to you, and what does that leave you responsible for?

An apartment deed conveys a defined unit plus an undivided proportionate share in the land, held with every other owner. Undivided is the operative word: the share is real, it is yours, it moves with the apartment on every future sale, and it can never be identified with any particular square metre of ground. A plot deed conveys a demarcated parcel with boundaries you can walk.

From that difference flow the rest: who may alter what, who maintains what, whose certificates you check, who is liable for what, and who has to be persuaded before anything changes. None of the rows below is a claim about which form is better. Both are ordinary, lawful ways to own property in India, and each carries obligations the other does not.

What this page will not do

  • Say land is the better asset. That is the oldest appreciation claim in the category and it is not checkable. This site does not print it.
  • Print stamp duty or registration figures. Both are set by state notification and revised. Each state's registration department publishes the current position.
  • Generalise across state lines. Revenue records, land-use rules and the registering office all change at a state border. The rows say where that matters.
  • Substitute for a title investigation. Nothing here tells you whether a specific title is sound. That is an advocate's work on the parent documents.

What the deed conveys

Apartment ownership
The apartment, defined by its boundaries within the building, together with an undivided proportionate share in the land beneath the project. The two are inseparable and are sold together, always.
Plot ownership
The parcel itself, with its survey identity, boundaries and measured extent, conveyed in whole. There is no undivided element.

Settled by The registered sale deed. Read the schedule of property in it — the schedule, not the sales brochure, is the description that binds.

Whether the land can be identified or dealt with separately

Apartment ownership
No. The share cannot be partitioned, fenced or transferred apart from the apartment, and no single owner can deal with the land.
Plot ownership
Yes, within the limits of the layout approval and applicable law: the parcel is identified on the ground and dealt with as a whole.

Settled by The deed's schedule and, for a plot, the approved layout plan showing the parcel with its number and dimensions.

Common areas and who ends up holding them

Apartment ownership
Common areas are conveyed to the association of allottees, as the RERA Act and the rules under it require, and are held for all owners. Your share in them is proportionate and undivided.
Plot ownership
The layout's roads, open spaces and infrastructure are dealt with under the layout approval — handed over to the local authority, or to an owners' association, as the approval and documents provide. Your plot is not part of them.

What you may change, and whose permission you need

Apartment ownership
Internal changes only, bounded by the structure, the sanctioned plan and the association's rules. Structural change is generally out of the question and anything affecting the façade or common services needs the association.
Plot ownership
You commission the design and build within the permissible FAR, setbacks, height and land-use rules for the plot, after obtaining a plan sanction and a commencement certificate from the authority with jurisdiction.

Settled by For an apartment, the association's bye-laws and the sanctioned plan. For a plot, the planning authority's development control rules for that specific parcel — obtained before a design is commissioned, not after.

Whose certificates you are checking

Apartment ownership
The promoter's: registration, sanctioned plan, commencement certificate, and the occupancy certificate for the block you are buying in. Ask whether the occupancy certificate is full or partial and which block it names.
Plot ownership
Two sets. The layout's — registration, layout approval, land-use position. And your own house's — plan sanction, commencement certificate and occupancy certificate, all of which are yours to obtain.

Settled by The certificates themselves, each read for the block or parcel it actually names.

The revenue record you will be asked for

Apartment ownership
The registered deed, an encumbrance certificate over a long period, and in Karnataka the khata held by the municipal body — a record of who is liable for property tax, not a record of ownership.
Plot ownership
The same deed and encumbrance discipline, plus the land record the state actually issues for land. Khata is a Karnataka municipal concept; Tamil Nadu records land through its own revenue system, including the patta.

Settled by The encumbrance certificate from the registering department of the state the land is in, and that state's own revenue record.

Where the current figure is published Karnataka Department of Stamps and Registration — the stamp duty and registration fee applicable in Karnataka, and the guideline values used to assess them. We print no rate.

Who maintains what

Apartment ownership
The association maintains the building, its services and the common areas, funded by your monthly contribution. You maintain the inside of your home.
Plot ownership
The layout maintains its shared infrastructure under whatever arrangement the approval provides. Your house — roof, walls, compound, services — is entirely yours to keep up, with nobody to collect from and nobody to blame.

Settled by The association's budget and bye-laws for an apartment; the layout's maintenance arrangement and any charges under it for a plot.

Insurance and liability

Apartment ownership
The association usually insures the structure and common areas; you insure your contents and, depending on the policy, internal fittings. Liability for common parts sits with the association.
Plot ownership
You insure the structure and the contents, and you carry the liability for the boundary wall, the compound and anything that happens on your land.

Settled by The association's policy schedule for an apartment, and your own policy for a plot and any house on it.

How lenders treat each

Apartment ownership
A home loan is the standard product, and on a project purchase it is generally disbursed against construction stages.
Plot ownership
A plot loan and a composite plot-plus-construction loan are separate products with separate terms, and lenders treat them differently. Ask which product applies and what conditions attach — including any requirement to begin construction within a stated period. Prudential norms are set by the Reserve Bank of India and each lender applies its own policy within them; we publish neither.

Apartment ownership
Move in. Fit-out is optional and bounded.
Plot ownership
Design, sanction, build and obtain an occupancy certificate for a house — a project of your own, on your own timeline, with your own contractors and your own supervision.

Settled by For a plot, the plan sanction and commencement certificate you apply for. Nothing about that timeline is stated anywhere on this website, because it is yours to set.

Neither answer is the right one

Who each of them suits

Two paragraphs, one for each side, and then the honest weaknesses of both. We are not going to end this page by recommending the thing we happen to sell more of.

Who apartment ownership suits

Apartment ownership suits someone who wants a finished home, a defined and bounded set of obligations, and shared responsibility for everything outside their own front door — and who is comfortable that decisions about the building are made collectively rather than by them.

Who plot ownership suits

Plot ownership suits someone who wants to control what gets built and when, is willing to run a construction project and then maintain a whole building alone, and values holding a demarcated parcel over holding a share in a larger one.

And where each one is weaker

Stated plainly, because a comparison that lists only advantages on both sides has told you nothing. Neither of these paragraphs is a reason not to buy — they are the things worth knowing before you do.

Apartment ownership

You cannot act alone on anything outside your walls, you are bound by the association's decisions and its competence, and the conveyance of common areas is an obligation routinely left outstanding, and we have not measured how often.

Plot ownership

Everything is yours: the design, the approvals, the construction risk, the maintenance and the security. There is no association to share the work, and an empty plot is a standing responsibility rather than a home.
